There are a few simple steps to make an application to a Small Claims Tribunal.

I can help you all the way through the application process as I have helped many students apply to small claims tribunals before and am now very familiar with the process.

  1. Click on the link below to the Small Claims Tribunal in your state or territory.

  2. Submit your application online (email me for the content to complete the “description of dispute” and any other section you need help with).

  3. Pay the Small Claims Tribunal application fee. The fee’s are listed below and range from $5 to $157 depending on the state or territory that you live in.

  4. IDP Education will contact you to resolve your complaint. They will possibly: offer you part of your money back from the tests that you had failed, give you free English lessons or offer you a free Enquiry On Results.

  5. Go to the Small Claims Tribunal for a hearing. I will give you all the information to present your argument.

If you feel angry that IDP Education have ripped you off. It is good to know that IDP Education will spend about $10,300 to respond to your small claims tribunal application. Application Fee: The VCAT application fee for a hearing with a claim of $500 to $10,000 is $174.10. For more information about VCAT application fees, please visit the VCAT fees webpage.

Fee Waiver: VCAT has a fee waiver for all or part of the application fee. If you have a low income with or without dependent children or are a students you may qualify for a fee waiver. Please visit the VCAT fee waiver webpage for more information.

New South Wales

New South Wales Civil and Administrative Tribunal

Application Fee: For an application under $10,000 the fee is only $47 and $5 if you have a concession card. These fees are the lowest in Australia. (I commend the New South Wales government for making the fees so low to allow EVERY person (foreigner or citizen) the chance to make a complaint irrespective of their financial position). Fee Waiver: There is no fee waiver, however there is a reduced application fee of only $5 if you have financial hardship.

Application Fee: The application fee for QCAT is in 3 brackets. Claims under $500 is $23.80. Claims between $500 to $1,00 is $61.00. Claims of $1,000 to $10,000 is $108.70. For more information about QCAT fees please visit the QCAT fees webpage.

Fee Waiver: The Western Australia Magistrates Court offer 3 types of fee waivers. They are for Concession Card holders, financial hardship and if the court hearing is in the interest of justice. For an International Students the easiest fee waiver to use is for financial hardship with regard to the income that you have as a student

Application fee: The fee for a claim under $2,000 is $68 and for a claim $2,001 to $10,000 is $140. More information please follow this link to the ACAT fees webpage.

Fee Waiver: The ACAT application fee can be waived if the registrar decides that the fee will bring you “financial hardship”. You will qualify to be deemed in financial hardship if: A person is on Centrelink payments with little or no assets, a person with a low income, with minimal assets and a number of dependents who have no income.
